Citing the state’s need to ensure the responsible development of Marcellus Shale, West Virginia Acting Governor Earl Ray Tomblin signed an executive order requiring the Department of Environmental Protection to implement emergency regulations for shale drilling. West Virginia’s current drilling rules deal only with conventional drilling. Under the order, signed July 12, 2011, a company must file public notice when drilling within municipalities and identify its water sources. Lists of fracking fluid additives and water management plans must also be filed with the DEP.
