West Virginia Approves Emergency Drilling Rule

On August 29, 2011, West Virginia Secretary of State Natalie Tennant approved the filing of an emergency rule by the Department of Environmental Protection that temporarily regulates Marcellus drilling. The rule governs drilling permit requirements, as well as operational rules protecting water and land resources, and includes public notice procedures for horizontal drilling. West Virginia emergency rules can last for 15 months. In a press release, Tennant said DEP plans to propose a permanent rule in early September. The DEP is now accepting public comment on the emergency rule.
