West Virginia Judge Overturns Morgantown Ban on Fracking

Monongalia County Circuit Judge Susan Tucker issued a ruling on August 12, 2011, overturning the Morgantown, West Virginia ban on fracking. According to the opinion, the state’s regulatory scheme preempts the city ordinance which only applied to the fracking of horizontal gas wells. The lawsuit was filed by Northeast Natural Energy, who owns two Marcellus well sites across the Monongahela River from Morgantown.
