Owner of Subsurface Rights Sues to Prevent Gas Pipeline


Essroc Cement Company (Essroc) recently filed suit in the U.S. District Court for the Western District of Pennsylvania seeking to prevent Nisource Corporate Services Co. and Hilcorp Energy Co. from constructing a natural gas pipeline through its property.  Essroc alleges that the proposed pipeline will would deny the company millions in mineral deposits.   

Essroc is in the business of extracting and processing limestone and other minerals.  The company owns the subsurface rights to the 1,700 acres surrounding its cement factory as well as the subsurface rights on an additional 2,000 acres throughout Lawrence County Pennsylvania.  Essroc claims that because safety measures prevent blasting near gas pipelines, if the proposed gas pipeline is constructed across its land, the company will be denied the ability to extract millions of tons of coal and limestone.
