On September 24, the District Court for the Middle District of Pennsylvania denied federal question jurisdiction and dismissed plaintiff’s federal takings claim finding that the claim was unripe. The Court explained that the federal takings claim was not ripe because plaintiff was required to first go through the State’s process for obtaining compensation for a taking under the Pennsylvania Eminent Domain Code.
